General Terms and Conditions of Sale, Delivery and Payment

1. Definitions 
a. Mes Étoiles is an online store that sells (branded-) clothes and accessories for babies and children and sells to retail consumers.
b. These General Terms and Conditions of Mes Étoiles are in accordance with the General Conditions Homeshopping ('Algemene Voorwaarden Thuiswinkel') of the Dutch Home-shopping Guarantee Association (' Nederlandse Thuiswinkel Waarborg organisatie').

2. Applicability  
a. These General Terms and Conditions exclusively apply to all offers, orders and agreements that have been concluded using the web-site of mesetoiles.nl
b. The acceptance of a offer or the placement of an order occurs under the acceptance of the applicability of these General Terms and Conditions. 
c. Deviation from these General Terms and Conditions can solely take place in writing.  In the case of partial deviation from these General Terms and Conditions, all other General Terms and Conditions will remain valid.

3. Orders
An order is made subject to acceptance by Mes Étoiles. Mesetoiles.nl has the right to refuse orders or request additional information. In case an order is not accepted by Mes Étoiles,  notification hereof will occur while stating the reason for non-acceptance.

4. Prices   
All  prices and charges are denominated in euro and are inclusive of VAT and, for delivery within The Netherlands, including delivery charges. For delivery in Belgium, a standard € 4.95 contribution to the delivery charges will apply (irrespective of the order size). For delivery to all foreign countries, excluding Belgium, the applicable cost of TNT Express will be charged.
When placing an order, you will receive an order confirmation by e-mail. This confirmation specifies  the total order-amount as well as payment details.  

5. Payment and Delivery 
Payment can be made by one of the following methods:  
a. iDEAL
If you bank via internet with ABN Amro, ING (Postbank), Rabobank of SNS. 
b. Bank transfer
Your order will be despatched after receipt of payment. 
c. Creditcard and Paypal
If you have a Visa, Mastercard, American Express or JCB creditcard. 
Your payment will be authorised online. No additional costs will be charged for payment by creditcard or Paypal.
d. Bancontact/Mister Cash
If you are banking online in Belgium with Axa, CBC, Dexia, Fintro, Fortis, ING , KBC or VDK Spaarbank.
e. Collect
Payment upon collecting the goods in our showroom in Moergestel.
If you pay with the aforementioned payment-methods a, c or  e, the processing will take place via the internet-cashier of Ogone Nederland: quick and safe.

Delivery generally takes place promptly after receipt of payment. You will receive an e-mail  confirmation as soon as your order is shipped. Within the framework of the rules of arm's length purchases we will execute all orders promptly, but at least within 30 days. However, in the case would possible be because the goods are temporarily not available from stock, or because of a delay due to other reasons, or an order can only be partially executed, you will be informed within 30 days after placing the order in which case you have the right to cancel the order without any charges. Your order is reserved for a maximum of 7 business days. In case your payment has not been received within these 7 business days, then you will receive a reminder per e-mail. 

Upon placing your order you will also receive a copy of our General Terms and Conditions. 

6. Returns and Exchanges
Mes Étoiles will do its utmost to deliver a perfect product to you. Nevertheless, should you not be satisfied with (part of) your order, you can subject the following, return these items within 7 business days from  receipt of the order without specification of reason and annul the order without any liability, with the exception of the charges of return shipment. The goods to be returned have to be in the original condition as received, so not worn, with tags attached and with original packaging. Funds which would have been paid by you will be refunded by Mes Étoiles within 30 days. In order to avoid disappointment afterwards and return shipments, we will be pleased to measure the clothes for you. Exchange is permitted within 7 business days from receipt of your order and after prior e-mail contact. Please bear in mind that the shipping charges of return shipments are for your own account. The goods to be exchanged have to be in the original condition and not worn, with tags attached and with original packaging. Subject to stock availability, goods can be exchanged with another size. If no longer available in stock, another article of clothing can be selected after prior consultation. 

ATTENTION: (a) Postage is due for every return-shipment. Unstamped or understamped return-shipments will not be accepted; (b) These conditions also apply in case of "Not Good Money Refund" ("Niet Goed Geld Terug");  

7. Cancellation
Cancellation of an order is permitted free of charge within 24 hours after placing the order, unless the shipment has already been despatched. To this end, we kindly request you to send a request per e-mail to info@mesetoiles.nl. The cancellation will be confirmed to you by e-mail. In the case you have already paid your order, Mes Étoiles will refund the amount promptly but in any case within 14 days. 

8. Claims
You are obliged to check the delivered goods immediately upon receipt and to notify any deficiencies in writing as soon as possible to info@mesetoiles.nl. In case the delivered goods would not be in accordance with the order, you have to notify Mes Étoiles  as soon as possible of the potential deficiencies or erroneously delivered goods.

Every complaint will be dealt with seriously. We strive to completely settle every complaint within 30 days. Should this not be accomplished within this term, you will be informed hereof in a timely manner.  Mes Étoiles strives for customer satisfaction. Should you have any questions or complaints on any of our services and/or products, we would be pleased to be informed by telephone or by e-mail.

10. Dispute-arrangement
Disputes regarding delivered or to be delivered goods can, subject to the following, be lodged by both yourself as well as by Mes Étoiles to the Dispute-committee Home-shopping ('Geschillencommissie Thuiswinkel'), P.O Box 90600, 2509 LP Den Haag, The Netherlands. Any dispute will only be taken up by the Dispute-committee, if you have firstly submitted your complaint to Mes Étoiles. Ultimately three months after lodging your complaint to Mes Étoiles , the dispute has to be taken up with the Dispute-committee. In the case you want to lodge a dispute with the Dispute-committee, Mes Étoiles is bound to this.   When Mes Étoiles will do that you have, within five weeks following a written request by Mes Étoiles, to provide your written notification whether or not you agree, or that you want the dispute to be taken up with the competent judge. If Mes Étoiles is not provided with your choice within the 5 weeks term, then Mes Étoiles is entitled to take up the dispite with the applicable competent judge. The Dispute-committee provides judgment subject to the conditions as set forth in the rules and regulations of the Dispute-committee. The decisions of the Dispute-committee are taken by way of binding advice. You have the possibility to bring the dispute before an independent dispute-committee. That can be the Dispute-committee 'Geschillencommissie Thuiswinkel' or equivalent dispute-committee, although the consumer can also bring the dispute before the applicable competent judge.   

11. Liability
All products within the assortment of Mes Étoiles comply with the strict demands applicable to children- and babyarticles. The delivered articles have the characterisctics which, based upon the agreement, may be expected in case of customary use.  Possible complaints can be presented to us in writing or per e-mail. The contents of this site have been established with the greatest care. We can not rule out that certain information is incorrect and/or incomplete.  Mes Étoiles is not liable for the consequences of incorrect or incomplete information on its website. Mes Étoiles is not responsible for typing-, publishing- and printing errors as a result of which, unintentionally, an erroneous selling price would be communicated. In the event this would be the case, we will adjust the price as soon as possible. Mes Étoiles can not be held responsible for deviations in colour as a result of display screen quality. 

12. Reservation of Title
Ownership of the delivered goods will transfer upon full payment to Mes Étoiles of applicable monies due.

13. Applicable Law 
Agreements and each provision of these General Terms and Conditions shall be governed by the laws of The Netherlands.
